Terms and Conditions (Consignment)

1. DEFINITIONS

1.1. “Company” means MDG Wonder Sdn. Bhd. (201701012065 (1226230-H)) trading as Attic House.

1.2. “Goods” means any item offered for sale by the Company in its capacity as an independent reseller (and not as an authorised dealer, distributor, or agent of any brand), including but not limited to new, pre-owned, or consigned luxury designer products sourced from third parties.

1.3. “Customer” means the purchaser of the Goods.

2. AUTHENTICITY

2.1. The Company is not an authorised dealer, distributor, or affiliate of any brand.

2.2. The Company represents, strictly to the best of its knowledge and belief, that the Goods are authentic, based on an assessment conducted by its internal authenticator in accordance with the Company’s internal standards and prevailing industry practices. The Customer acknowledges and agrees that such assessment is opinion-based, inherently subjective, and may be subject to differing opinions, and shall not constitute any representation, guarantee, or warranty of authenticity.

2.3. The Customer further acknowledges that the decision to purchase is made entirely at the Customer’s own discretion and risk, and that no claim shall arise against the Company by reason only that a differing opinion on authenticity is subsequently formed.

2.4. The Customer expressly assumes all risks associated with the purchase and confirms that the decision to purchase is made entirely at the Customer’s own discretion.

2.5. If the Customer has any doubt whatsoever as to the authenticity or condition of the Goods, the Customer shall refrain from purchasing the same, and any failure to do so shall not give rise to any claim against the Company.

2.6. No representation is made by the Company that the Goods will be accepted, serviced, repaired, or recognised by any brand owner or official boutique or official distributor of the Goods.

3. NO WARRANTY / EXCLUSION OF LIABILITY

3.1. The Company provides no warranties, guarantees, or representations, whether express or implied, including but not limited to:

(a) merchantability;

(b) fitness for a particular purpose;

(d) absence of defects (latent or otherwise).

3.2. The Company shall not be liable for any:

(a) defects arising from the purchase;

(b) wear and tear;

(d) damage caused by third parties or repair attempts.

3.3. All risks in the Goods pass to the Customer immediately upon completion of sale and/or delivery.

3.4. The Company shall not be liable for any:

(a) defects arising from the purchase;

(b) wear and tear;

(d) damage caused by third parties or repair attempts.

3.5. The Company shall have no obligation whatsoever to provide any after-sales services, including but not limited to repair, cleaning, restoration, improvement, submission, or assistance with warranty claims, or any form of liaison or engagement with brand owners, whether before or after the sale.

3.6. The Company takes reasonable efforts to ensure accurate colour representation in our photos and sales materials. The colour of the Goods may vary due to technical limitations in colour rendering on your device, and no warranty or guarantee is given as to an exact colour match.

4. CUSTOMER’S DUTY TO INSPECT

4.1. The Customer confirms that:

(a) The Goods have been fully inspected, examined and/or checked before purchase;

(b) The Customer has been given adequate opportunity to examine the Goods;

4.2. Failure to inspect shall not entitle the Customer to any claim.

5. FINAL SALE / NO RETURN / NO REFUND

5.1. All sales are final.

5.2. NO return, refund, exchange or cancellation is allowed under any circumstances, including but not limited to:

(a) change of mind;

(b) dissatisfaction with the condition of the Goods;

(d) inability to claim for warranty from any brand owner or official boutique or official distributor;

(e) subsequent discovery of wear or defects.

6. CONFIDENTIALITY / SOURCE OF GOODS

6.1. The Company’s sourcing, suppliers, and procurement details of the Goods are strictly confidential.

6.2. The Customer shall have no right whatsoever to request or obtain:

(a) original purchase invoices or receipts;

(b) source or supplier identity;

6.3. The Company reserves absolute discretion whether to disclose any such information, and any disclosure shall not create any obligation or precedent.

7. INDEMNITY

7.1. The Customer agrees to indemnify and hold harmless the Company against all claims, demands, losses, damages, costs, and expenses arising from:

(a) misuse or handling of the Goods;

(b) third-party claims relating to the Goods post-sale;

8. NO WAIVER

8.1. Any goodwill, assistance or communication by the Company shall NOT:

(a) constitute a waiver of these Terms and Conditions; or

(b) create any legal obligation or admission of liability.

9. GOVERNING LAW AND JURISDICTION

9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.

9.2. The Company and Purchaser submit to the exclusive jurisdiction of the Malaysian courts.

10. ENTIRE AGREEMENT

10.1. These Terms and Conditions constitute the entire agreement between the Parties and supersede all prior representations, communications or understandings.

11. SEVERABILITY

11.1. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
